Please carefully read and fully understand the contents of each clause, especially the clauses that exempt or limit the responsibility of smart energy storage, the clauses that restrict user rights, the clauses that stipulate dispute resolution methods and judicial jurisdiction (such as the relevant provisions in Article 18), as well as the separate agreements or rules for opening or using a certain service. Limitations, disclaimers, or other clauses that involve your significant rights and interests may be highlighted in bold, underlined, or other forms to remind you to pay special attention.

Unless you have fully read, understood, and accepted all the terms of this agreement, you have no right to use smart energy storage services. If you click "Agree" or "Next", or if you use smart energy storage services, or express or imply acceptance of this agreement in any other way, it shall be deemed that you have read and agreed to sign this agreement. This agreement shall have legal effect between you and Smart Energy Storage and become a binding legal document for both parties.

If you do not have full capacity for civil conduct due to factors such as age and intelligence, please read and judge whether you agree to this agreement with the legal guardian (hereinafter referred to as the "guardian"), and pay special attention to the terms of use for minors.

If you are a user outside Chinese Mainland, you should also abide by the laws of your country or region when entering into or performing this agreement.

1、 [Scope of Agreement]

1.1 This agreement is an agreement between the user and smart energy storage regarding their use of smart energy storage services. "Smart energy storage" refers to the operational related units that may exist for smart energy storage and/or its related services. "User" refers to the user of smart energy storage services, more commonly referred to as "you" in this agreement.

1.2 Smart energy storage services refer to the products and services provided by smart energy storage to users, including but not limited to smart energy management, Internet value-added, advertising and other products and services. The specific services are subject to the actual provision of smart energy storage (hereinafter referred to as "the service").

1.3 This agreement also includes the "Smart Energy Storage Privacy Policy", and when you use a specific smart energy storage service, the service may have separate agreements, relevant business rules, etc. (hereinafter collectively referred to as "separate agreements"). Once the above content is officially released, it shall be an integral part of this agreement and you shall also abide by it. Your acceptance of any individual agreement mentioned above shall be deemed as your complete acceptance of this agreement. Your acceptance of this agreement shall be deemed as your acceptance of the Smart Energy Storage Privacy Policy.

2、 [Account and Password Security]

2.1 You may need to register an account when using this service. Please carefully read and comply with the relevant separate agreement regarding the specific rules for your account usage.

2.2 Smart Energy Storage reminds you to keep your account and password safe. After using it, you should safely exit. Due to your poor storage, you may suffer from account theft or password theft, and the responsibility is borne by yourself.

2.3 In order to enhance user experience and/or technical convenience, the account of this service may include numbers, letters or their combinations, as well as various forms such as phone numbers, email addresses, etc. When you register a certain form of account, smart energy storage may come with another manifestation of that account. The specific account form, account system, and relationship between accounts shall be based on the actual information provided by Smart Energy Storage.

2.4 During the use of this service, you may be able to set up nickname, avatar, signature, message, and other information for the account you are using, as well as create or manage settings for your name, image, introduction, and other information. You shall ensure that the content and form of this information comply with laws and regulations (the "laws and regulations" in this agreement refer to the current effective laws, administrative regulations, judicial interpretations, local regulations, departmental rules, and other normative documents of the user's region/country, as well as any modifications and supplements to such laws and regulations from time to time, as well as relevant policy provisions, etc.), public order and good customs Social ethics and smart energy storage platform rules will not infringe upon the legitimate rights and interests of any entity.

2.5 Some third-party websites or services may use smart energy storage accounts as one of their login methods. You are aware that, unless otherwise specified by Smart Energy Storage, these websites or services are not operated by Smart Energy Storage. You should make your own judgment on the security and availability of such third-party websites or services, and bear the relevant risks and responsibilities.

3、 User Personal Information Protection

3.1 Protecting user personal information is a fundamental principle of smart energy storage. Smart Energy Storage will collect, use, store, and share your personal information in accordance with the provisions of this agreement and the Smart Energy Storage Privacy Policy. If there are no clear provisions on the protection of personal information in this agreement, the content of the Smart Energy Storage Privacy Policy shall prevail.

3.2 During the process of registering an account or using this service, you may need to fill in some necessary information. If there are special provisions in national laws and regulations, you need to fill in your true identity information. If the information you provide is incomplete, you may not be able to use this service or may be restricted during use.

In general, you can browse and modify the information you submit according to relevant product rules, but for security and identity recognition considerations (such as number appeal services), you may not be able to modify the initial registration information and other verification information provided during registration.

3.4 Smart energy storage will use various security technologies and procedures as much as possible to establish a comprehensive management system to protect your personal information from unauthorized access, use, or disclosure.

3.5 Smart Energy Storage will not transfer or disclose your personal information to any third party unless:

(1) Relevant laws and regulations or requirements from judicial and administrative authorities.

(2) To transfer in order to complete a merger, division, acquisition, or asset transfer.

(3) Necessary to provide the service you requested.

(4) According to the Smart Energy Storage Privacy Policy or other relevant agreement rules, it can be transferred or disclosed to any third party.

3.6 Smart energy storage places great emphasis on the protection of personal information of minors. If you do not have full civil capacity, you should obtain the consent of your guardian before using smart energy storage services.

4、 [How to use this service]

4.1 This service is for your personal non-commercial use only, unless otherwise agreed with Smart Energy Storage.

4.2 The rights obtained by you under the terms of this agreement are non transferable.

4.3 You shall not use any means (including but not limited to third-party software, plugins, plugins, systems, devices, etc.) to interfere with, damage, modify or exert other influence on this service.

4.4 You shall use this service through smart energy storage provided or recognized methods, and shall not log in or use this service through any third-party software, plugins, plugins, systems, devices, etc.

4.5 Without authorization from Smart Energy Storage, no one shall use any third-party software, plugins, plugins, systems, etc. to view or obtain any relevant information, data, etc. related to Smart Energy Storage, Smart Energy Storage partners, or users included in this service.

5、 [Provide services as is]

You understand and agree that:

5.1 This service is provided to the best of our existing technology and conditions. Smart energy storage will make every effort to ensure the continuity and security of services, but it cannot foresee and prevent legal, technological, and other risks at any time. Smart energy storage is exempt from liability for such risks within the scope allowed by law, including but not limited to force majeure, viruses, Trojans, hacker attacks, system instability, third-party service defects, government actions, and other possible service interruptions Data loss and other losses and risks.

Due to business strategy arrangements or adjustments, there may be differences in the specific content of smart energy storage services that users in different regions can use. The specific content provided by smart energy storage shall prevail.

6、 [Self provided equipment]

6.1 You should understand that when using this service, you need to prepare terminal equipment related to the relevant services (such as computers, mobile terminals, and necessary network access devices) on your own, and bear the necessary costs (such as phone bills, internet fees, etc.).

6.2 You understand and agree that your use of this service will consume resources such as your terminal devices and bandwidth.

7、 Advertising

7.1 You agree that Smart Energy Storage may send or display advertisements or other information (including commercial and non-commercial information) to you through various means such as SMS, email, or electronic messages, either by itself or by a third party. The specific sending and display form, frequency, and content of advertisements or other information shall be subject to the actual provision of Smart Energy Storage.

7.2 Smart energy storage will conduct advertising business in accordance with relevant laws and regulations. You agree that you shall carefully assess the authenticity and reliability of the advertisements appearing in this service, and unless otherwise specified by law, you shall be responsible for any actions taken as a result of such advertisements.

8、 [Service fees]

8.1 Some services for smart energy storage are provided on a paid basis. If you use paid services, please comply with relevant agreements.

8.2 Smart energy storage may modify and change the charging standards and methods of paid services according to actual needs, and smart energy storage may also start charging for some free services. Before the aforementioned modifications, changes, or start of charging, smart energy storage will be notified or announced on the corresponding service page. If you do not agree to the above modifications, changes, or paid content, you should stop using the service.

8.3 When smart energy storage reduces the charging standards for paid services or changes paid services to free services, smart energy storage reserves the right not to provide refunds or fee adjustments to original paying users.

9、 Products or services provided by third parties

When you use third-party products or services on the smart energy storage platform, in addition to complying with the provisions of this agreement, you should also comply with the third-party user agreement. Smart energy storage and third parties shall each bear their respective responsibilities for possible disputes within the scope of legal provisions and agreements.

10、 [Based on software to provide services]

10.1 You may need to download software during the use of this service, and for these software, Smart Storage grants you a personal, non transferable, and non exclusive license. You may only use these software for the purpose of using this service.

10.2 In order to improve user experience, ensure service security, and ensure product functionality consistency, smart energy storage may update the software. You should update the relevant software to the latest version, otherwise smart energy storage does not guarantee the normal use of the software or services.

10.3 Smart energy storage may develop different software versions for different terminal devices, and you should choose to download the appropriate version for installation based on the actual situation. You can directly obtain the software from the smart energy storage platform, or from a third party authorized for smart energy storage. If you obtain software or an installation program with the same name as the software from a third party without authorization from Smart Energy Storage, Smart Energy Storage cannot guarantee that the software or service can be used normally, and will not be responsible for any losses caused to you as a result.

Unless authorized in writing by Smart Energy Storage, you are not allowed to engage in any of the following behaviors:

(1) Remove copyright information from the software and its copies.

(2) Reverse engineering, reverse assembly, reverse compilation, or other attempts to discover the source code of software.

(3) Use, rent, lend, copy, modify, link, reprint, compile, publish, publish, and establish mirror sites for the intellectual property rights of smart energy storage.

(4) Copy, modify, add, delete, hook up or create any derivative works of software or data released into any terminal memory during software operation, interaction data between client and server during software operation, and system data necessary for software operation, including but not limited to the use of plugins External or unauthorized third-party tools/services for accessing software and related systems.

(5) By modifying or forging instructions, data, or any other means during the operation of software, adding, deleting, or altering the functionality or effectiveness of the software, or operating or disseminating software or methods used for the aforementioned purposes to the public, regardless of whether these actions are for commercial purposes.

(6) Log in or use smart energy storage software and services, or create, publish, and disseminate third-party software, plugins, plugins, systems, devices, etc. that are not developed or authorized for smart energy storage, through any means such as third-party software, plugins, plugins, systems, devices, etc.

11、 Intellectual Property Declaration

11.1 The intellectual property rights of the content provided by Smart Energy in this service (including but not limited to web pages, text, images, audio, video, charts, computer software, etc.) belong to Smart Energy. The intellectual property rights of the content generated by the user's use of this service belong to the user or relevant rights holders, unless otherwise agreed between you and Smart Energy.

Unless otherwise specified, the copyright, patent rights, and other intellectual property rights of the software relied upon by Smart Energy Storage for providing this service belong to Smart Energy Storage.

11.3 The copyright or trademark rights of commercial logos such as "smart energy storage" and "smart energy storage new energy" used in this service belong to smart energy storage.

11.4 The intellectual property rights of the above and any other content contained in this service are protected by laws and regulations. Without written permission from smart energy storage, users, or relevant rights holders, no one is allowed to use or create related derivative works in any form.

12、 [User's illegal and irregular behavior]

12.1 When using this service, you must comply with laws and regulations, and are not allowed to produce, copy, publish, or disseminate information containing the following content or engage in related activities. You are also not allowed to provide convenience for producing, copying, publishing, or disseminating information containing the following content or engaging in related activities:

(1) Oppose the fundamental principles established by the constitution.

(2) Harming national security, leaking state secrets, subverting state power, and undermining national unity.

(3) Harming national honor and interests.

(4) Inciting ethnic hatred and discrimination, and undermining ethnic unity.

(5) Disrupting national religious policies, promoting cults and feudal superstitions.

(6) Spreading rumors, disrupting social order, and undermining social stability.

(7) Spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crimes.

(8) Insulting or slandering others, infringing on their legitimate rights and interests.

(9) Violating the seven bottom lines of laws and regulations, socialist system, national interests, legitimate rights and interests of citizens, social public order, moral standards, and information authenticity.

(10) Prohibited by relevant laws and regulations, this agreement, relevant agreements, rules, etc.

12.2 If you violate relevant laws and regulations or the provisions of this agreement during the use of this service, relevant national authorities or institutions may file lawsuits, fines or take other sanctions against you, and request assistance from Smart Energy Storage. Therefore, if any damage is caused to you or others, you shall bear full responsibility on your own, and Smart Energy Storage shall not assume any responsibility.

12.3 If you violate the provisions of this agreement, Smart Energy Storage has the right to make independent judgments and take corresponding measures, including but not limited to deleting, blocking relevant content, or disconnecting links through technical means. At the same time, smart energy storage has the right to take measures, including but not limited to suspending or terminating the services provided to you, restricting, suspending, freezing or terminating your use of smart energy storage accounts, and pursuing legal responsibilities, depending on the nature of user behavior.

12.4 If you violate the provisions of this agreement and cause any losses to any party, you shall independently bear the responsibility; If smart energy storage suffers losses as a result, you should also compensate accordingly.

13、 [Comply with local laws and regulations]

13.1 During the use of this service, you shall comply with relevant local laws and regulations, and respect local morals and customs. If your behavior violates local laws, regulations or moral customs, you should bear independent responsibility for it.

13.2 You should avoid violating laws and regulations or getting involved in political and public events due to the use of this service. Otherwise, Smart Energy has the right to suspend or terminate your service.

14、 [Content sent and disseminated by users and complaint handling]

14.1 The content you send or disseminate through this service (including but not limited to web pages, text, images, audio, videos, charts, etc.) shall be the sole responsibility of you.

14.2 The content you send or disseminate should have a legitimate source, and the relevant content belongs to you or you have obtained necessary authorization.

14.3 If the content you send or disseminate violates laws and regulations or infringes on the rights of others, Smart Energy Storage has the right to make independent judgments and take measures such as deleting, blocking, or disconnecting links.

14.4 If you are complained about by others or you complain about others, Smart Energy Storage has the right to provide necessary information such as the subject information, contact information, and complaint related content of the parties involved in the dispute to the relevant parties or departments, in order to timely resolve the complaint dispute and protect the legitimate rights and interests of all parties.

You guarantee to be responsible for the authenticity, legality, and validity of the information, materials, evidence, etc. you provide in the complaint handling process.

15、 【 Force Majeure and Other Exemptions 】

15.1 You understand and agree that in the process of using this service, you may encounter risk factors such as force majeure, which may affect this service. Force majeure refers to objective events that are unforeseeable, insurmountable, and unavoidable, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as war, unrest, government actions, etc. When the above situation occurs, Smart Energy Storage will strive to cooperate with relevant units in a timely manner and strive to handle it in a timely manner. However, any losses caused to you by Smart Energy Storage will be exempted from liability within the scope permitted by law.

15.2 Within the scope permitted by law, smart energy storage shall not be liable for service interruption or obstruction caused by:

(1) Damaged by computer viruses, Trojans, or other malicious programs, hacker attacks.

(2) The computer software, system, hardware, and communication lines of the user or smart energy storage have malfunctioned.

(3) Improper user operation or unauthorized use of this service by users through non intelligent energy storage.

(4) Outdated program versions, device aging, and/or compatibility issues.

(5) Other situations that cannot be controlled or reasonably foreseen by smart energy storage.

15.3 You understand and agree that in the process of using this service, you may encounter risks caused by network information or other user behaviors. Smart Energy Storage is not responsible for the authenticity, applicability, and legality of any information, nor is it responsible for any damage caused to you due to infringement. These risks include but are not limited to:

(1) Information containing threatening, defamatory, offensive, or illegal content that comes from anonymous or pseudonymous sources.

(2) Suffering from any psychological or physiological harm, as well as economic losses, caused or likely to be caused by others misleading, deceiving, or otherwise.

(3) Other risks caused by network information or user behavior.

15.4 Smart Energy Storage has the right to handle illegal and irregular content in accordance with the provisions of this agreement. This right does not constitute an obligation or commitment of Smart Energy Storage, and Smart Energy Storage cannot guarantee timely detection of illegal activities or corresponding handling.

Under no circumstances should you trust loans, request passwords, or other information related to property. If it involves property operations, please make sure to verify the identity of the other party first, and regularly pay attention to the tips on preventing fraud crimes related to smart energy storage.

16、 Effectiveness and Change of Agreement

16.1 By using this service, you are deemed to have read and accepted the terms and conditions of this agreement.

16.2 Smart Energy Storage reserves the right to modify the terms of this agreement as necessary. You can check the latest version of the agreement terms on the relevant service page.

16.3 After the terms of this agreement are changed, if you continue to use the software or services provided by Smart Energy Storage, it shall be deemed that you have accepted the changed agreement.

17、 [Changes, Interruptions, and Terminations of Services]

17.1 You understand and agree that smart energy storage may make changes to the service content based on business strategy adjustments, and may also interrupt, suspend, or terminate the service.

17.2 In the event of merger, division, acquisition, or asset transfer of smart energy storage, smart energy storage may transfer relevant assets under this service to a third party; Smart energy storage can also transfer some or all of the services and corresponding rights and obligations under this agreement to a third party for operation or performance after unilateral notification to you. The specific transferee shall be subject to the notification of smart energy storage.

17.3 If any of the following situations occur, Smart Energy Storage has the right to interrupt or terminate the services provided to you without notice:

(1) According to laws and regulations, you are required to submit truthful information, but the personal information you provide is not true, or does not match the information at the time of registration without providing reasonable proof.

(2) You have violated the provisions of relevant laws and regulations or the provisions of this agreement.

(3) According to laws and regulations, as required by judicial or regulatory authorities.

(4) For safety reasons or other necessary circumstances.

17.4 Smart energy storage has the right to charge according to the provisions of Article 8.2 of this agreement. If you fail to pay in full and on time, Smart Energy Storage has the right to interrupt, suspend or terminate the provision of services.

17.5 You are responsible for backing up the data stored in this service on your own. If your service is terminated, Smart Energy Storage has the right to permanently delete your data from the server, except as otherwise provided by laws and regulations. After the service is suspended or terminated, Smart Energy Storage has no obligation to provide or return data to you.

18、 Jurisdiction and Legal Application

18.1 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland region of the People's Republic of China (excluding conflict of laws).

18.2 This agreement is signed in Longgang District, Shenzhen City, Guangdong Province, People's Republic of China.

If there is any dispute or controversy between you and smart energy storage, you should first resolve it through friendly negotiation; If negotiation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction in the place where this agreement is signed (i.e. Longgang District, Shenzhen City, Guangdong Province, China).

The titles of all clauses in this agreement are for reading convenience only and have no actual meaning, and cannot be used as a basis for interpreting the meaning of this agreement.

18.5 Regardless of the reasons for partial invalidity or unenforceability of the terms of this agreement, the remaining terms shall remain valid and binding on both parties.

18.6 If there are multiple language versions of this agreement, such as Chinese and English, and the corresponding content is inconsistent, the Chinese version shall prevail.

19、 【 Terms of Use for Minors 】

19.1 If the user is under 18 years old, they are minors and should read this agreement and use this service under the supervision and guidance of their guardian.

19.2 Minors who have not yet delved into the world are easily confused by virtual images on the internet, have a strong curiosity, lack the ability to adapt to situations, and are easily exploited by malicious individuals without self-protection ability. Therefore, underage users should pay attention to the following matters when using this service, improve safety awareness, and strengthen self-protection:

(1) Recognize the difference between the online world and the real world, avoid getting addicted to the internet and affecting daily learning and life.

(2) When filling out personal information, strengthen personal protection awareness to prevent malicious elements from causing harassment in personal life.

(3) Under the guidance of a guardian or teacher, learn to use the internet correctly.

(4) Avoid meeting or participating in social activities with unfamiliar netizens at will, in order to prevent criminals from taking advantage and endangering their own safety.

19.3 Guardians and schools should provide more guidance for minors to use this service. Especially, parents should care about their children's growth, pay attention to communication with their children, guide their children on the safety issues they should pay attention to when going online, and take preventive measures.

19.4 If an adult who has reached the age of 18 does not have full capacity for civil conduct for any reason, the relevant provisions of the terms of use for minors in this agreement shall apply.
